The Jinja high court has dismissed an Election Petition filled by NRM’s Munyirwa Fredrick against the incumbent Hon. Walyomu Moses Muwanika for Kagoma county.
Munirwa petitioned court challenging Walyomu’s victory. The petitioner claimed that Walyomu lacked academic qualifications and that he also rigged elections.
Munirwa Fredrick had petitioned Court, challenging the victory of Walyomu over many issues like violence in the election, election interference among others!
However, High Court Judge, His Lordship Justice Dr. Joseph Mulangira has dismissed the case with costs due to lack of enough evidence!
Court dismissed the petition on grounds that it lacked Substantial evidence. Justice Mulangira in his ruling said that petitioner Munyirwa Frederick failed to produce substantial evidence to support his petition rendering it incompetent.
Court consequently declared Hon. Moses Walyomu Muwanika as the duly elected member of parliament for Kagoma county.
The trial judge Murangira Joseph ordered the petitioner(Munyirwa) to meet the costs of Walyomu.
Through his Lawyers of Wanume and Galisonga Julius and company advocates Munyirwa said they are going to petition the court of appeal challenging the decision of the high court.
Meanwhile Walyomu’s Lawyer’s Semanda Ben Ziwa and Ambrose Tebyassa said they will be waiting for court’s guidance on the costs awarded to their client.
